Terms of Service
Last updated:
These terms cover what you can expect from us, and what we ask of you, when you shop with ShopPilot. We've tried to keep them plain — but they are still a contract, so please read them.
1. Who we are
ShopPilot is operated by Anihera Tait, a sole trader based at 8 Crawford Close, Amberley 7410, Hurunui, New Zealand, trading as ShopPilot (company registration pending). You can reach us at hello@shoppilot.co.nz.
In these terms, "we", "us", and "ShopPilot" mean the seller above. "You" means the person placing the order.
2. Placing an order
When you submit an order on our site, that is an offer to buy. Your order is accepted by us only when we send you an order confirmation email. Until then we may decline the order for any reason, including stock unavailability, suspected fraud, or a pricing error.
You must be at least 18 years old to place an order, or have a parent or guardian do so on your behalf.
3. Prices, currency, and GST
Prices on the site are shown in New Zealand Dollars (NZD) and include any taxes that apply at our end. ShopPilot is currently operated by a sole trader below the NZ GST registration threshold, so prices do not include GST and we do not issue GST tax invoices. If that changes, we will update this section before it takes effect and add GST to prices on the site.
If you are buying from outside New Zealand, any import duties, GST/VAT, customs charges, or other taxes levied by your country are your responsibility. See the Shipping Policy for more.
We try hard to get prices right, but if a product is listed at a clearly wrong price (for example, a $200 item shown at $2) we reserve the right to cancel and refund the affected order rather than honour the obvious error. We will tell you before cancelling so you can re-order at the correct price if you want.
4. Product descriptions and images
We do our best to describe each product accurately and to show it as it really looks. Colours on a screen can vary from the real item, and small natural variations between batches are normal. Where dimensions or weights are given, we treat them as approximate unless stated otherwise.
If a product is materially different from how it was described on the site, your rights under the Consumer Guarantees Act 1993 apply. See our Refund and Returns Policy for how we handle that.
5. Payment
We accept payment via Shopify Payments, which supports the major credit and debit cards as well as the digital wallets enabled at checkout. Your card details are handled directly by Shopify Payments under their own security standards (PCI DSS); we do not see or store your full card number.
6. Shipping and delivery
Estimated delivery times, tracking, customs, and lost-parcel handling are set out in our Shipping Policy. Risk of loss passes to you when the carrier marks the parcel as delivered to the address you supplied.
7. Refunds, returns, and faults
Our Refund and Returns Policy sets out our 14-day change-of-mind window, what happens when a product is faulty or damaged, and the categories of item we cannot accept back for hygiene reasons. Nothing in these terms or in that policy limits the guarantees you have under the Consumer Guarantees Act 1993 when you buy for personal, domestic, or household use.
8. Your responsibilities
When you use our site and order from us, you agree:
- to give accurate contact and delivery details (an incorrect address is your responsibility — see the Shipping Policy);
- to use the site for lawful purposes only and not to attempt to break, probe, scrape, or overload it;
- not to use ShopPilot branding, product photography, or content for commercial resale or any misleading purpose.
9. Intellectual property
The ShopPilot name, our logo, the photographs and copy on the site, and the overall layout are owned by us or licensed to us. You can browse, save, and share our pages for personal, non-commercial use. You cannot copy them onto another store, use them in advertising for a different business, or sell or redistribute them without our written permission.
Trademarks, brand names, and product names belonging to the manufacturers of items we stock remain the property of their respective owners.
10. Liability
Where you are buying as a consumer for personal, domestic, or household use, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 give you rights that we cannot contract out of. Nothing in these terms is intended to limit those rights.
Subject to that, and to the extent the law allows, our total liability to you for any claim arising out of an order is limited to the amount you paid for the affected order. We are not liable for indirect or consequential loss (for example loss of profit, loss of business opportunity, or loss of data) that arises from your use of the site or the products we sell.
If you are buying in trade rather than as a consumer (for example, for resale or for use in a business), you agree that section 43 of the Consumer Guarantees Act and section 5D of the Fair Trading Act allow the parties to contract out of those Acts and that the parties have agreed to do so, except where it is unreasonable for them to be excluded.
11. Things outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, including carrier strikes, customs delays, severe weather, natural disasters, pandemics, or supplier closures. Where this affects your order we will let you know as soon as we can and work with you on a sensible outcome — refund, replacement, or wait it out.
12. Changes to these terms
We may update these terms from time to time. The version that applies to your order is the one published on this page at the time you placed it. The "Last updated" date at the top shows when the current version took effect.
13. Governing law and disputes
These terms and any order placed under them are governed by the laws of New Zealand. Any dispute will be heard in the courts of New Zealand. If a particular clause in these terms is found to be unenforceable, the rest of the terms keep on applying.
14. Contact
Questions about these terms can go to hello@shoppilot.co.nz. We aim to reply within one working day.
